The state of South Dakota continues to be in flagrant violation of the Indian Child Welfare Act, as well as the Due Process Clause of the Fourteenth Amendment. Lakota People’s Law Project has concluded that the state of South Dakota cannot adequately provide legally Child Protective Services for Native Americans in South Dakota. We believe that the targeting of Native American children by South Dakota Dept. of Social Services has been motivated by a long-standing anti-Native American discriminatory racial animus.
